Attached please find the Motion of the [Second Lien] Noteholder Committeefor Order Granting Standing to
Commence, Prosecute, and Settle Claims on Behalf of the Debtors 'Estates [ECF No. 3694]. Specifically, the
2L Noteholder Committee is seeking to pursue claims for constructive and intentional fraudulent transfers,
breach of fiduciary duty, and aiding and abetting breach of fiduciary duty against CEC, CEC's and CEOC's
directors and officers, and the Sponsors. Among the defendants on the proposed complaint are Apollo, Marc
Rowan and David Sambur.
