HEADING
CONFIDENTIALITY AGREEMENT
Paul Cassell and Bradley Edwards, individually, and Alan Dershowitz,
individually, enter this Confidentiality Agreement as a material condition to
their resolution of the above-captioned lawsuit. In particular, each party
agree to the following:
1. The Parties agree that the source (and amount} of any money or other
financial instrument that is paid to either Party in settlement of this
matter is strictly confidential and shall not be disclosed at any time to
any third party;
2. Any third party who is advised of the source {and amount} of the
settlement must sign a document acknowledging that such third party is
aware of this confidentiality provision and is bound by it;
3. Each Party agrees that if either Party breaches the confidentiality
provision of this Agreement, that the appropriate remedy for such
breach is the disgorgement of the entire settlement amount received by
that Party. If a breach is alleged, and there is no agreement as to its
occurrence, each Party agrees to binding and confidential arbitration
before a mutually agreed arbitrator {or Court?}
