spoke at some length with jay last night, two approaches, one to forego any amended complaint, lose
the advantage of a "viable" albeit nominal complaint as a defense to punitives, the other,
recommended by Fowler, to refile
i put jay in touch with ackerman so he can assess their viewpoint, potential claims, give you final
recommendation
