Good morning: Same presentation today, but he said he thinks his memory for the incident (injury to his
neck) may be impaired because of his sleep apnea. He is supposed to get his CPAP machine today. He is
aware he will be returning to SHU, but said he is feeling unwell due to his inability to sleep and numbness in
his arrn. He requested to have one good night of sleep with his CPAP and will return to SHU with a cellmate
tomorrow. He then asked if he could remain down here where it is "safe" for the entire week. I told him he
can stay down one more night to receive his CPAP and a good night's sleep, but that he would be returned
to SHU tomorrow. It was explained that there is no mental health issues precluding him from returning to
SHU tomorrow and that we could not house him in the SW/Hospital area because he felt safe or more
comfortable for him. It was explained to him that he would be placed in a safe situation in the SHU. He will
remain on psychological observation today and will transition to the SHU tomorrow. Thank you, Elissa

Inmate Epstein seems psychologically stable.
He complained that his right arm was numb and hanging earlier. Nurse Columbo saw him.
He again said his right arm still feels somewhat numb and he said he cannot make a fist with that hand. He
also said he has numbness on his neck. I informed Nurse Columbo.
He stated the toilet in his cell was running for 45 minutes last night and he could not take the noise. He is
going to try the toilet before going to legal today and if it does not shut off, he will be moved to another
cell.

August 20, 2019, addressed to the United States Attorney's Office for the Southern District of
New York ("USAO-SDNY"), the Bureau of Prisons ("BOP"), and the Federal Bureau of
Investigation ("FBI"), and your request and subpoena dated August 23, 2019, addressed to the
Metropolitan Correctional Center ("MCC"). The Subpoena and Requests seek medical and
mental records relating to Jeffrey Epstein, as well as MCC records and protocols relating to Mr.
Epstein's death.
Because the Subpoena and Requests seek information from DOJ employees acquired as a
part of their performance of their official duties, the Subpoena and Requests are governed by
certain DOJ regulations ("Touhy regulations") which, inter alia, direct DOJ attorneys to consider
the factors set forth in 28 C.F.R. § 16.26(a) and (b). See 28 C.F.R. § 16.23; see also United Stares
ex rel. Touhy v. Rage'', 340 U.S. 462 (1951); 28 C.F.R. § 16.21 et seq. Touhy regulations
"provide guidance for the internal operations of the Department of Justice," and do not create
substantive rights. Id. § 16.21(d).
Among the factors which must be considered in deciding whether to make disclosures
pursuant to a demand, 28 C.F.R. § 16.26 requires consideration of "[w)hether such disclosure is
appropriate under the rules of procedure governing the case or matter in which the demand
arose." That factor alone is dispositive here: disclosure of these materials is not appropriate
under the rules of procedure governing United States v. Jeffrey Epstein, 19-CRIM-00490
(S.D.N.Y.) because that proceeding has terminated. See Nolle Prosequi, United States v. Jeffrey

Martin G. Weinberg. I spoke with Mr. Miller on the phone last week, and he indicated that they wanted the
records before the nolle pros hearing tomorrow. I read the conversation as a defense attorney asking for his
client's records in the context of the criminal case (not as the attorney asking on behalf of the estate), but I'm
happy to request more info from them if you think we should.

defense counsel that a person close to Mr. Epstein received a phone call from an individual named
(phonetic) who claimed to be an investigator with the MCC and told the individual that
Mr. Epstein's body was ready to be picked lat the hospital and that the individual could make
arrangements for retrieval of the body. left his phone number as
Can you please confirm whether that individual is in fact with BOP and/or MCC? Defense counsel is
understandably concerned that they (and others with connections with Mr. Epstein) are starting to get
hoax or otherwise inaccurate information through phone calls and emails. And we would again
respectfully but urgently request that if there is information like this that needs to go to
representatives for Mr. Epstein, that it come to us so we can pass it along to his counsel with
confidence that it is true and accurate.

It is frankly unbelievable to me that BOP is issuing public press releases on this before telling us basic
information so that we can relay it to his attorneys who can relay it to his family. When can we expect to get
either some sort of statement we can pass along to counsel as accurate and reliable or have a call with
someone?
I understand from the Marshals that they have been unsuccessful in reaching anyone with authority at BOP,
and given the BOP press release that was just put out I assume we need to speak with someone there. Please

that they (and others with connections with Mr. Epstein) are starting to get hoax or otherwise inaccurate information through
phone calls and emails. And we would again respectfully but urgently request that if there is information like this that needs to
go to representatives for Mr. Epstein, that it come to us so we can pass it along to his counsel with confidence that it is true and
accurate.
(Separately, if it is accurate that BOP / MCC is prepared to release Mr. Epstein's body, his defense counsel is extremely concerned
about whether that has been enough time for a full autopsy and any other investigative steps, and we would want to confirm
that the FBI team addressing this matter has also been informed—but that's only if this is not a hoax, obviously.)
Please advise as soon as possible, as the individual is waiting to know whether they should take steps to retrieve the body.

It is frankly unbelievable to me that BOP is issuing public press releases on this before telling us basic information so that we can
relay it to his attorneys who can relay it to his family. When can we expect to get either some sort of statement we can pass along
to counsel as accurate and reliable or have a call with someone?
I understand from the Marshals that they have been unsuccessful in reaching anyone with authority at BOP, and given the BOP

At Judge Berman's invitation, I went to the hearing in Epstein's case this morning. As you likely know, the
government had asked the court to grant their request for a nolle pros. At the start of the hearing, Judge
Berman said he was using the hearing as an opportunity for the victims to be heard. He then gave the
government and defense counsel a chance to speak.
As expected, defense counsel was dramatic and almost in tears during part of his presentation. He started his
statement by stating the elephant in the room was: "What happened to our client!?" He repeated allegations
from the media regarding conditions at MCC, officers sleeping, staff not cooperating with the investigation,
etc. "In a word, Yikes!!" He talked about how the government was supposed to keep Epstein safe and we
(MCC) failed. He called conditions at MCC "horrific and medieval" with no sunlight, "rife with
vermin," limited exercise, and water all over the floor. He fueled conspiracy theories, stating the timing of
Epstein's suicide was "implausible" given they had just filed a motion to dismiss with a "good likelihood of
success." He represented that in their meetings with Epstein, defense counsel did not see a suicidal
person. He stated the "800 pound gorilla" in the room was the surveillance tape: "There is a tape directly
outside Epstein's door that hasn't been produced!" He also disclosed that defense counsel had an
independent doctor present during Epstein's autopsy (which I didn't know until today). That doctor opined
that the broken bones found in Epstein's neck were more consistent with strangulation. The doctor also
stated Epstein's injuries "were far more consistent with assault." Defense counsel claimed the medical
examiner's findings were initially inconclusive, but then the examiner saw nine minutes of video footage from
the stairway at MCC, which made her change her conclusion to suicide. (I have no idea if that claim is true.)
Defense counsel said the medical examiner's conclusion and the stairway footage are suspect because the
camera outside Epstein's cell was destroyed/corrupted and MCC has no explanation for that. He said it is
convenient for the camera outside his cell to have been corrupted and it is ridiculous to think the camera
would have been non-operational "for months" before the suicide.

Most importantly, defense counsel stated they were "all for finding out the truth!" To that end, they asked
Judge Berman to oversee the investigation into Epstein's death. They claimed the Court has inherent
authority to find out what happened; this is an area of intense public interest and court supervision is
important. Defense counsel argued that they need the Court to help them find out the truth. I haven't
looked at the case yet, but counsel cited a case from Alaska written by Judge Sullivan (not SDNY J. Sullivan)
concerning a Senator for the proposition the Judge Berman had oversight authority/jurisdiction. Defense
counsel represented that in the Alaska case, the court appointed an independent lawyer to investigate a
particular situation. (Again, I haven't looked at the case, but I'll find it and forward.) Defense counsel also
asked Judge Berman to go to SHU at MCC and see the conditions for himself. (Defense counsel
obviously didn't know that & I give tours to his clerks every summer, although we don't typically go
to SHU.)
Various attorneys for the victims spoke, too. One noted the "timing of Epstein's death is curious" and most
of them seconded defense counsel's request for Court involvement in the investigation, although they
admitted there was questionable authority for the Court to do so.
The government did not say much except pointing out the lack of jurisdiction for the Court's involvement.
They also said that it was up to individual defendants and their counsel to address any complaints at MCC
with the judge presiding over their case.
Then we proceeded to hear statements from Epstein's victims for over 2.5 hours. I won't rehash the
statements, but some were very detailed accounts of rape/assault. Many of the victims expressed anger at
the government and MCC for Epstein's death. Some of them seconded defense counsel's request for court
oversight in the investigation. Some bought into the conspiracy theories. Many of them asked for Epstein's
co-conspirators to be charged & brought to justice.
At the end of the conference, Judge Berman did not dismiss the case. He simply thanked the victims and
ended it. I expect he will decide whether to grant the nolle pros and whether to get involved in the
investigation at a later date, probably in a written opinion.
Anyway, I wanted to give an update while my notes were fresh. Please let me know if you have any
questions/concerns. I'm also cc-ing Warden Petrucci on this; I verbally updated him, but he may need to
forward this summary to someone higher up the food chain than me.
